Terms of Service

These terms govern access to TruSender’s website, private beta, dashboard, email integrations, and AI-assisted security features.

1. Agreement to these terms

By accessing or using TruSender (the “Service”), you agree to these Terms of Service. If you use the Service for an organization, you confirm that you have authority to accept these terms and connect the organization’s systems on its behalf. If you do not agree, do not use the Service.

2. The Service

TruSender provides AI-assisted email-security analysis, threat indicators, human-review workflows, administrative tools, evaluation features, and optional connections to supported email platforms. The Service is intended to help identify phishing, scams, impersonation, malware, and other malicious email activity while reducing unnecessary alerts.

Security decisions require judgment

Automated analysis can produce false positives, false negatives, incomplete results, or unavailable results. TruSender is a security aid—not a guarantee that any message, sender, link, attachment, or environment is safe.

3. Private beta and pre-release features

TruSender is currently in private beta. Beta functionality may be incomplete, inaccurate, interrupted, changed, or discontinued. We may impose usage limits, modify eligibility, reset test data, or require additional configuration as the Service develops.

Optional integrations—including Google/Gmail, Microsoft 365, and import tools—may be offered for testing or selected deployments and are not guaranteed to remain part of the final product.

4. Accounts and administrators

You must provide accurate account information, keep credentials and authentication factors secure, and promptly report suspected unauthorized access. Organization owners and administrators are responsible for assigning appropriate roles, authorizing integrations, configuring retention and remediation settings, and managing their users.

You are responsible for activity performed through your account unless caused by our failure to use reasonable security measures.

5. Mailbox authorization and customer responsibilities

You may connect, import, or direct us to process email data only when you have the legal right and organizational authority to do so. You are responsible for:

  • obtaining any required notices, consents, or administrator approvals;
  • ensuring your use complies with employment, privacy, communications, and security laws;
  • reviewing decisions before relying on them for material action;
  • selecting appropriate audit, quarantine, purge, retention, and deletion settings; and
  • maintaining appropriate backups and independent security controls.

Unless expressly configured by an authorized administrator, TruSender should not be assumed to automatically delete, quarantine, or restore email.

6. Acceptable use

You may not:

  • access mailboxes, accounts, or data without authorization;
  • use the Service to create, deliver, conceal, or facilitate malicious email or malware;
  • probe, disrupt, overload, bypass, or interfere with the Service or its security controls;
  • reverse engineer the Service except where applicable law expressly permits it;
  • upload unlawful content or content that infringes another person’s rights;
  • resell or provide access to the Service without our written permission; or
  • use the Service in a way that violates law or a connected provider’s terms.

7. Customer data and privacy

As between you and TruSender, you retain your rights in information you submit, connect, or import (“Customer Data”). You grant us a limited right to host, copy, process, transmit, and analyze Customer Data only as needed to provide, secure, support, and improve the Service as described in our Privacy Policy.

You are responsible for the accuracy, quality, legality, and source of Customer Data. We will not use private mailbox content to train a generalized model shared across customers unless covered by a separate written agreement or clear permission.

8. Third-party services

The Service may depend on third-party email platforms, identity providers, infrastructure, threat intelligence, malware scanners, and other services. Your use of a third-party service is also governed by that provider’s terms. We do not control those services and are not responsible for changes, outages, access revocations, or actions caused by them.

9. TruSender ownership and feedback

TruSender and its licensors retain all rights in the Service, including software, interfaces, models, rules, documentation, graphics, trademarks, and improvements. These terms do not transfer ownership of the Service or Customer Data.

If you provide product feedback, you allow us to use it without restriction or payment, provided we do not publicly identify you without permission.

10. Access and future fees

Private-beta access may be invitation-only and may be provided without charge. We may introduce paid plans or usage limits later, but we will provide the applicable pricing and obtain agreement before charging you. You are responsible for third-party platform, network, or infrastructure fees associated with your use.

11. Suspension and termination

You may stop using the Service and disconnect integrations at any time. We may suspend or terminate access when reasonably necessary to address security risk, unlawful or abusive use, a material breach of these terms, nonpayment under a future paid plan, or discontinuation of the private beta.

After termination, Customer Data will be handled under the retention and deletion provisions in our Privacy Policy and any applicable written agreement.

12. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TRUSENDER DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR WILL DETECT EVERY THREAT.

Nothing in these terms excludes a warranty or right that cannot lawfully be excluded.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRUSENDER WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL; OR SECURITY INCIDENTS CAUSED BY A MESSAGE OR THREAT THE SERVICE DID NOT DETECT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRUSENDER’S TOTAL LIABILITY ARISING FROM THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID TRUSENDER FOR THE SERVICE DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR US$100. These limits apply regardless of the legal theory and even if a remedy fails its essential purpose.

14. Indemnity

To the extent permitted by law, you will defend and indemnify TruSender from third-party claims, damages, and reasonable costs arising from your unauthorized or unlawful use of the Service, your Customer Data, or your violation of these terms. This obligation does not apply to the extent a claim results from TruSender’s own unlawful conduct.

15. Changes to the Service or terms

We may change the Service and update these terms as the product develops. The effective date at the top identifies the current version. We will provide additional notice when required by law or when a material change affects current users. Continued use after an updated version takes effect means you accept the revised terms.

16. General terms

These terms and the Privacy Policy are the entire agreement for the public website and private beta unless a separate written agreement applies. If a provision is unenforceable, the remaining provisions remain in effect. A delay in enforcing a right is not a waiver. You may not transfer these terms without our consent; we may transfer them as part of a reorganization, financing, merger, acquisition, or sale of the Service.
